Hire Agreement

Definitions:

Client – the person/s hiring a trailer from 4 Wheel Skips Pty Ltd.

Business – 4 Wheel Skips Pty Ltd, the company providing the trailer for hire to the Client.

 

I/we as named here agree that I am/we are the Client in this Hire Agreement.

I/we, as the Client:

  • Agree to only use the trailer for its intended purpose.

  • Agree that I/we understand that the use of a trailer carries with it dangers and risks of injury and accept all dangers and risks.

  • Agree that I/we understand that I am/we are entitled to use the trailer for the hire period and for any agreed extension of the hire period.

  • Agree not to modify or permit modification of the trailer.

  • Agree to notify the Business of any breakdown or failure of the trailer.

  • Agree to only load allowed waste, as per the Hire Package (Mixed Waste, Green Waste or Cover Material) into the trailer.

  • Agree to only load up to the Hire Package weight, or where accidental overloading occurs, to unload the overloaded portion or pay the associated additional charge to cover the overloaded portion.

  • Agree not to load any liquid waste or hazardous material (having properties that makes it potentially harmful to human health or the environment) into the trailer.

  • Agree that any waste that I/we load into the trailer remains in my/our ownership until accepted by the Lithgow Solid Waste Facility.

 

 

I, as the Business:

  • Agree to provide the trailer in a serviceable state.

  • Agree to collect the trailer and dispose of the loaded waste via the Lithgow Solid Waste Facility.

  • Agree to maintain appropriate insurance for the trailer.

Indemnity – to the full extent permitted by law I/we as the Client releases, discharges and indemnifies the Business from all claims and demands on the Business arising out of or consequent on the use or misuse of the trailer during the Hire Period.

Liability – I/we as the Client assume all risks and liabilities for and in respect of the trailer and for all injuries to or death of persons and any damage to property howsoever arising from the Client’s possession and use of the trailer during the Hire Period.

Title to the trailer – I/we as the Client acknowledge that the Business retains title to the trailer at all times and that I/we have no entitlement to sell, sub-hire or part with the trailer.

 

The Client and the Business may negotiate the loading, transport and depositing of accepted recyclable material in association with the trailer collection and waste disposal at the Lithgow Solid Waste Facility. Any associated costs will be paid by the Client.
